The petitioner has been made accused in Raghunathpur P.S. Case No. 105 of 2006 dated 24.06.2014 registered under Section 392 of the Indian Penal Code.
In the FIR though he was not named but in course of investigation his name transpired on the basis of confession of coaccused as well as on the basis of recovery of certain articles.
Patna High Court Cr. WJC No.1075 of 2014 dt.02-04-2015 2 / 2 Despite the case having been instituted in December, 2006, he could not be apprehended till date. The police obtained non-bailable warrant of arrest against him in November 2013 but they failed to execute it and, thereafter, on the requisition of police, processes under Sections 82 and 83 Cr. P.C. have been issued. The order, by which the processes have been issued under Sections 82 and 83 of the Code of Criminal Procedure in the aforesaid police case, is under challenge before this Court.
I do not find any merit in this application. Accordingly, the application is dismissed.
