Petitioner is languishing in custody since 18.08.2016 in connection with Siwan Town P.S. Case No. 488 of 2016 for offences punishable under Section 302/34 of the Indian Penal Code.
Dead body of the son of the informant was found from near the house of the petitioner. It is stated in the F.I.R. that since blood was found inside the house of the petitioner, petitioner and her husband was suspected to have committed the murder. The house of the petitioner was locked and the petitioner was not there. No motive for the alleged occurrence is there against the petitioner.
Patna High Court Cr.Misc. No.52460 of 2016 (2) dt.07-12-2016 2/2 Submission is that petitioner is a female and there is no eyewitness of the occurrence. There is no allegation as to why the petitioner would commit murder.
Considering the aforesaid facts, moreover the alleged blood found in the house of the petitioner is yet to be forensically examined, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan/Successor Court, in connection with Siwan Town P.S. Case No.488 of 2016.
