The petitioner apprehends his arrest in connection with Maniyari P.S. Case No.286 of 2021, registered for the offences punishable under Sections 406, 419 and 420 of the Indian Penal Code.

It is alleged that the informant gave advance of Rs.1,50,000/- to the petitioner for executing sale deed with regard to a piece of land for which an agreement was prepared and thereafter the informant also paid Rs.20,00,000/- through RTGS, but the petitioner did not execute sale deed. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no

Considering the fact that the petitioner is ready to return Rs.21,50,000/- to the informant, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing the bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Maniyari P.S. Case No.286 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. The learned court below is directed to accept the bail bond of the petitioner after verifying the fact that the petitioner has already returned the aforesaid amount to the informant.

Both parties are directed to withdraw the criminal cases filed against each other. If the criminal cases filed between the parties shall not be withdrawn, the parties would be at liberty to file a petition before this Court for appropriate order.
