Petitioners apprehend arrest in a case registered for the offence punishable under sections 307/379/354/506 and other ancillary sections of the Indian Penal Code. As per the prosecution case, petitioner no.1 inflicted farsa blow on the informant causing head injury. Petitioner no.2 assaulted Md. Nayim causing fracture injury on his left hand. Petitioner no.3 snatched gold chain of the informant's bhabhi. Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Parties are co-villagers and in fact no such occurrence took place. Petitioners claim clean antecedent.

Patna High Court CR. MISC. No.23772 of 2023(2) dt.27-06-2023 2/2 Considering the fact that petitioner no.2 caused grievous injury, his prayer for bail is rejected. As other injuries sustained by the informant side have been found to be simple in nature, prayer for bail of petitioners no. 1 and 3 is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Mahua Police Station Case No. 484 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
