The petitioner seeks bail in Sour Bazar P.S. Case No. 230/2014, registered for the offences punishable under Sections 302, 201, 120B and 34 of the Indian Penal Code. The informant Shobi Rishideo alleged that Chauthi Rishideo took his son Brihaspati Rishideo with him from his house, but the dead-body of his son was recovered by the police. The informant alleged that the petitioner and other accused persons might have killed his son Brihaspati Rishideo. Petitioner had illicit relation with the wife of Brihaspati Rishideo (deceased). It is submitted that petitioner happens to be brother-inlaw of the wife of the deceased. The deceased had verbal altercation with his father-in-law, but father-in-law has already

Patna High Court Cr.Misc. No.47030 of 2016 (3) dt.22-12-2016 been enlarged on bail vide order dated 20.04.2015 passed in Cr. Misc. 3073/2015. There is no eye-witness of the occurrence. Save and except suspicion there appears no tangible material against the petitioner.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge IInd, Saharsa in connection with Sour Bazar P.S.
