The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 408 and 468 of the Indian Penal Code.

The prosecution case is that the petitioner took rupees one lakh as loan and promised to return the same, but the money was not returned. The payment was made through cheque.

It is submitted by learned counsel for the petitioner that the petitioner is a dealer of construction material and the informant took construction material on credit and for non-payment of the same the case has been lodged. The

Patna High Court Cr.Misc. No.36962 of 2015 (2) dt.11-09-2015 2/2 impugned order reflects that the passbook was examined by the learned court below when it was not found whether the money was withdrawn or not.

Considering the nature of accusation and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 110 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
