The petitioner seeks bail in connection with Ayar P.S. Case No. 32 of 2016 registered for the offences punishable under Sections 341, 323, 353, 504 and 307 of the Indian Penal Code.
The allegation against the petitioner is that the informant as ASI was on his official duty and was engaged in vehicle checking during Panchayat Election and when the informant tried to stop the petitioner, he dashed the informant causing injury to him.
It has been submitted on behalf of the petitioner that no offence under Section 307 of the Indian Penal Code is made out against the petitioner as the injuries caused to the informant
Patna High Court Cr.Misc. No.54731 of 2016 (2) dt.20-12-2016 2/2 are simple in nature, the petitioner has falsely been implicated in the present case and he is in custody since15.10.2016. Heard the learned APP also.
Having heard both sides, in view of the fact stated above that the petitioner is in custody since 15.10.2016 and the injuries caused to him are simple in nature, let the petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Ayar P.S.
