Petitioner is in custody in connection with G.O. Case No. 999 of 2018 arising out of Bahera P.S. Case No. 479 of 2018 for the offence under sections 467, 471 and 420 of the Indian Penal Code and Section 30(a), 32(iii) and 41(i) of the Bihar Prohibition and Excise Act, 2016.

In the instant case total 150 liters of foreign liquor was seized from the Innova Car from the orchard near a village. Learned counsel for the petitioner submits that recovery was not made from the possession of the petitioner. The petitioner is in custody since 10.2.2020. Considering the submission that nothing was recovered from the possession of the petitioner, the Court is
