The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,323,324,307,504 and 506 of the Indian Penal Code. The prosecution case is that the informant was laying down foundation of the house on his land when protest was made by the accused persons. Thereafter co accused Bhola assaulted with sword on the head of the informant, petitioner no. 1 assaulted with lathi to the informant when the informant raised alarm and rushed to the house of his uncle
Patna High Court Cr.Misc. No.38857 of 2015 (2) dt.30-09-2015 2/3 Ram Nath Choudhary then he was also assaulted by co accused Bhola. Co accused Birbal assaulted with lathi to the cousin of the informant causing grievous injury. It is submitted by the learned counsel for the petitioners that in the background of land dispute the accusation has been levelled. It is further submitted that the informant has received three injuries out of which two injuries are bruises of marginal size over middle finger of left land and occipital region when opinion has been kept reserved with regard to the third injury on left elbow region. It is further submitted that petitioner no. 1 has also received injury on his head. There is counter version of the occurrence also. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the thrust of accusation against co accused Bhola, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Siwan Mufassil P.S. Case No. 137 of 2015 subject to the conditions
