Petitioner seeks bail in S.Tr.No.442 of 2018 arising out of Sultanganj P.S. Case No.07/18 registered for the offence under Sections 302, 324/34 of the I.P.C..

Allegation as per the F.I.R. is that the son of the informant was called by some person and later on his dead body was recovered.

Submission on behalf of the learned counsel for the petitioner is that except suspicion there is nothing against the petitioner and two other co-accused have already been granted bail by this Court vide orders dated 19.06.2018 and 23.07.2018 passed in Cr.Misc. No.35150 of 2018 and Cr.Misc.No.33752 of 2018 respectively. Charge sheet has already been submitted.

Patna High Court Cr.Misc. No.64382 of 2018 (2) dt.26-10-2018 2/2 Heard the learned A.P.P. and the informant who opposed the prayer for bail of the petitioners.

Having heard both sides and in view of the facts and circumstances of the case, stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge, Bhagalpur, in S.Tr.No.442/18 arising out of Sultanganj P.S. Case No.07/18 subject to the condition that bailers must be of local having sufficient properties within the jurisdiction of the court concerned.
