The application is for grant of bail for the offence under Sections 30 (a) of the Bihar Excise (Amendment) Act, 2016. It has been submitted on behalf of the petitioner that though it is alleged that there is recovery of 10 bottles of royal stage of 750 ml. each but it has not been written in the FIR or in the seizure list that it was Royal Stage wine or water. The petitioner is in custody since 29.10.2016 and there is no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides. In view of the fact that the petitioner is in custody for about two months and there is no criminal antecedent, let petitioner be enlarged on bail on

Patna High Court Cr.Misc. No.55471 of 2016 (2) dt.23-12-2016 2/2 furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of CJM-II, Begusarai in connection with Naokothi P.S.Case No.85 of 2016 having G.R.No.3428 of 2016.
