Learned counsel for the petitioner undertakes to remove the defects within two weeks.

In view of the undertaking given by the petitioner, the matter has been taken up for consideration. Heard Ms. Kumari Anupam, learned counsel for the petitioner and Mr. Prem Kumar Jha, learned Additional Public Prosecutor for the State.

The petitioner has renewed his prayer for grant of bail in connection with Barauli P.S. Case No.44 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The prayer for bail of the petitioner was earlier

Patna High Court CR. MISC. No.31693 of 2021(2) dt.13-04-2022 2/2 rejected by this Court vide order dated 12.10.2020 passed in Cr. Misc. No.23377 of 2020 considering that he was arrested while carrying 600 litres of Indian Made Foreign liquor in his Bolero jeep.

Learned counsel for the petitioner submitted that the petitioner is in custody for more than two years and the trial is at a very nascent stage.

Learned Additional Public Prosecutor for the State has opposed the prayer for grant of bail to the petitioner. Considering the nature of the offence, period undergone by the petitioner in custody as also the stage of trial, he is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Session Judge, Gopalganj in connection with Barauli P.S. Case No.44 of 2020.
