This application is filed for quashing the order dated 12.10.2012 passed by Judicial Magistrate, 1st Class, Madhubani in Tr. No. 2508 of 2015 arising out Complaint Case No. 993 of 2012 under the offence punishable under Section 498(A) of the Indian Penal code.
The learned counsel for the petitioner submits that the matter has been settled between the parties and in that view of the matter she has prayed that the case be allowed. The notice has not been sent to Opposite Party No. 2. There will no useful purpose be served by keeping the matter

This application is disposed of with the direction to the Court below to verify the fact, as to whether the matter has been settled between complainant and the accused. If the Court below finds that the matter has been settled, the same will drop the criminal case against the petitioner. If it is found that the matter has not been settled, the Court below will proceed in the matter in accordance with law in the present case. With the aforesaid observation, this application is disposed of.
