2. The petitioner seeks bail in Gopalpur P.S. Case No. 506 of 2025, registered for offences punishable under Sections 103(1) and 3(5) of the BNS, 2023.
3. As per the allegations, the son of the informant was admitted in Sarthi Nasha Mukti Kendra, Ilahibag for rehabilitation. It is alleged that on 02-12-2025, the informant was told that her son had died. On reaching the centre, she found marks on his body. She alleged that the Manager of the rehabilitation centre and others had killed her son.
4. Learned counsel further submits that petitioner is innocent and has falsely been implicated in the present case. He further submits that petitioner is a munshi of the centre in question. He has got no antecedent. Similarly situated co-
Patna High Court CR. MISC. No.20532 of 2026(4) dt.26-05-2026 2/3 accused person has already been granted regular bail by this Court vide order dated 01.04.2026 passed in Cr. Misc. No. 13341 of 2026.
5. Learned APP has opposed the prayer for bail.
6. This Court has considered the submissions made on behalf of both sides. The petitioner was merely a munshi. He had no role in the treatment, management, or administration of the institution. His role is therefore materially different from that of the persons who were in charge of the deceased. He has been in custody since 03-12-2025 and has no criminal antecedent. A co-accused who was similarly placed has already been granted bail by this Court. Having regard to the peripheral role of the petitioner and the parity with the co-accused, this application is allowed.

Accordingly, let the petitioner named above be released on bail on furnishing a bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned Judicial Magistrate- 1st, Patna/ concerned Court below, in connection with Gopalpur P.S. Case No. 506 of 2025.
8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of
