The petitioner apprehends his arrest in Patliputra P.S. Case No. 290 of 2016 registered for the offences punishable under Sections 47, 48, 54 and 55 of the Bihar Excise Act. The police got information that Vijay Kumar used to supply liquor at the rate of 1500-2000/-. On such Vijay Kumar was apprehended and on enquiry he disclosed that the petitioner Rewati Kumar Karn @ Rewati Kumar @ Karan who lives in Adri Lane on rent supplied liquor to him. On such the informant went to search, the wife of the petitioner found concealing key of Maruti Swift Car and from the vehicle different articles including SIM card and other papers relating to the petitioner were recovered.
Patna High Court Cr.Misc. No.11312 of 2017 (3) dt.04-05-2017 2/2 Learned counsel for the petitioner submits that the wife of the petitioner was arrested by the police. This Court in Cr. Misc. No. 43417 of 2016 passed stricture against the informant. The petitioner has falsely been implicated in the case. The petitioner is not the owner of the car. The car has already been released in favour of its owner. It is further submitted that all the documents have been taken from the house of the petitioner and the informant showed the same to have been recovered from the vehicle but, it appears from the records and the case diary that Maruti Swift Car bearing Registration No. BR01CV-5247 was searched and different brands of foreign liquor were recovered. The documents belong to the petitioner were also recovered from the car. The petitioner was also in possession of the car. Vijay Kumar also disclosed that it was the petitioner who used to supply liquor on demand.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
