The petitioner is apprehending his arrest in connection with Mushahari P.S.Case no.250 of 2018 , registered for offences punishable under Sections 363,365, 366(A), 307/34 of the Indian Penal Code.

Prosecution story is that three persons entered inside the house of the informant, fired at the husband of the informant and took away the daughter of the informant.

Submission of the learned counsel for the petitioner is that they have falsely been implicated in this case. Heard learned A.P.P. also and from perusal of the impugned order it appears that the girl in her statement recorded under Section 164 Cr.P.C. has stated against the petitioner and further stated that they forcibly took her away.

No.20789 of 2019(2) dt.08-05-2019 2/2 Having heard both sides and in view of allegation as mentioned in the statement recorded under Section 164 Cr.P.C.I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to move for regular bail, which will be considered by the learned court below on the basis of materials available on the record.
