In the present case, the petitioner is seeking bail in Excise Case No.903 of 2019 arising out of Murliganj P.S. Case No. 293 of 2019 registered for the offence punishable under Section 30 (a) of Bihar prohibition & Excise Act, 2016. The allegation has been made that about 30 liters of illegal liquor was recovered from the door/courtyard of coaccused Mahadeo Yadav in presence of two independent witnesses and those witnesses disclosed the name of the petitioner, who managed to escape, however, counsel for the petitioner submits that he is in judicial custody since 24.02.2020. It is claimed that his antecedent is clean. Considering the facts and circumstances of the case,

No.19184 of 2020(2) dt.10-06-2020 2/2 the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Excise Act, Madhepura in connection with Excise Case No.903 of 2019 arising out of Murliganj P.S. Case No. 293 of 2019 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court/prosecution would be at liberty to take steps for cancellation of his bail bonds.
