JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 17-05-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Kateya P.S. Case No. 190 of 2016/ G.R. No. 2466 of 2016 for the offences punishable under sections 272 and 273 of the I.P.C and section 57 of the Bihar Prohibition and Excise Act, 2016.

Allegedly, in the house of co-accused Sanjay Pasi raid was conducted and 15 liters of country made liquor was recovered and Paras Turha was apprehended. He stated the names of the persons who had succeeded in fleeing away including the petitioner Basdeo Pasi.

Submission is of false implication and that the name

No.14353 of 2017 (2) dt.17-05-2017 2/2 of the petitioner has come in the confessional statement of coaccused Paras Turha, besides that there is no material against the petitioner, nothing has been recovered from his house or from his premises and as such he deserves sympathetic consideration. The learned A.P.P. submits that Paras Turha has taken the name of the petitioner also at once after his arrest. In the facts and circumstances as stated above, considering that the name of the petitioner has come in the confessional statement of co-accused Paras Turha and as such the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Gopalganj in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
