NILU AGRAWAL ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in judicial custody since 22.07.2016 in connection with Ara Muffasil P.S. Case No. 343 of 2015 registered for the offence punishable under Sections 47A of the Excise Act.

The allegation as per the First Information Report is that the petitioner along with Hari Kishun Singh was selling illegal liquor and the police seized 210 bottles of 200 ML liquor. It has been submitted by the learned counsel for the petitioner that she is innocent and has falsely been implicated in the aforesaid case. He further submits that similarly situated coaccused Hari Kishun Singh has since been granted the privilege of

Patna High Court Cr.Misc. No.50887 of 2016 (2) dt.25-11-2016 2/2 bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 45723 of 2016 on 22.10.2016. He further submits that the petitioner has no criminal history.

However, learned A.P.P. for the State submits that the petitioner is named in the First Information Report, hence, opposes the prayer for bail.

Be that as it may, considering the period of custody and that co-accused has already been granted the privilege of bail, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of Sri P.K. Pandey, learned Judicial Magistrate, Ara, Bhojpur in connection with Ara Muffasil P.S. Case No. 343 of 2015.
