1. The Petitioner seeks quashing of the order dated 17.08.2012 by which the Ad hoc Additional Sessions Judge, III, Nalanda at Biharsharif, has refused to summon the Opposite Party No.2 in Sessions Trial No.153 of 2004 arising out of Silao P.S. Case No.195 of 2002.

2. Having gone through the order impugned, I find that it was for good reason that the Trial Court has refused such a prayer.

3. Hence, finding no merit in the application, it is dismissed.

4. The Trial Court is directed to conclude the trial expeditiously without granting unnecessary adjournment to any party

Patna High Court CR. REV. No.88 of 2013 dt.09-03-2015 2/2 for which reason the Trial Court shall send a list of the witnesses fixing specific dates for their examination along with a copy of this order to the concerned Superintendent of Police, who is directed to ensure the attendance of the witnesses on the date fixed so that there is no further delay in the trial.
