The petitioner apprehends his arrest in Case No. 263(C )3 Ex of 2016 instituted for the offence under Section 30(a) of Bihar Excise Act, 2016.

It is alleged that twenty-eight liters of country made liquor has been recovered from the premises of this petitioner. The petitioner managed to run away. The seizure list along with prosecution report has been filed which supports the allegation against this petitioner.

Therefore, this court is not inclined to grant

Patna High Court Cr.Misc. No.3159 of 2017 (2) dt.02-02-2017 2/2 petitioner anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is hereby rejected in connection with Case No. 263 (C)3 Ex of 2016.

The petitioner is directed to surrender before the court below within four weeks from today and seek regular bail which shall be disposed of in accordance with law preferably on the same day without being prejudiced by this order. (Sanjay Priya, J.) ravi/- U T
