JUSTICE SANJAY PRIYA ORAL ORDER 26-04-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Musrigharari P.S. Case No. 78 of 2016 instituted for the offence under Sections 302/34 of the Indian Penal Code.

Petitioner is husband of the deceased. It is alleged that she was married with the petitioner in the year 2009. She died in her Sasural due to unnatural death.

The Sessions Judge has mentioned in the impugned order that in the post mortem report it has come that death has occurred due to Asphyxia by hanging.

In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands

Patna High Court Cr.Misc. No.15727 of 2017 (2) dt.26-04-2017 2/2 rejected.

Petitioner may surrender before the court below and make prayer for regular bail which shall be considered on its own merit.
