JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 31-08-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Sections 392 and 411 of the Indian Penal Code.
The prosecution case, in brief, is that while the informant was returning after attending a meeting with cas of Rs.37,950 and document in black bag by a Glamour red colour motorcycle and when he reached near the Tetaria village, he saw that three unknown persons were pursuing him by the motorcycle. He informed to his Manager Sanju Kumar Maurya and in the meantime three persons came there and caught hold the bag and on proetest one persons assaulted him by means of helmate upon back side of his head and he fell down. After sometime, the Manager and Manish Kumar reached there and lifted him. They managed to take away the bag with screen touch mobile.
Patna High Court CR. MISC. No.18530 of 2020(4) dt.31-08-2020 2/2 It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in this case. The petitioner is neither named in the F.I.R. nor he was apprehended on the spot. No incriminating article has been recovered from his conscious physical possession. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. There is nothing in the record indicating the complicity of the petitioner in the occurrence barring the confessional statement of co-accused Pintu Kumar which has no evidentiary value in the eye of law. The petitioner has no criminal antecedent and has been languishing in custody since 24.01.2020. Learned APP for the State opposed the bail petition.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Hilsa, Nalanda in connection with Islampur P.S. Case No.503 of 2019.
