JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section47 of the Excise Act. Twenty bottles containing 750 ml. each Indian made foreign liquor, are said to have been recovered from the house of Sagar Sharma and it is alleged that the petitioner was a tenant of said Sagar Sharma and the recovery was made from his rented room. Furthermore, the informant claims that earlier, the petitioner was made accused in three cases of Excise Act. Submission on behalf of petitioner is that the petitioner is languishing in jail custody since 07-02-2016 and as a matter of fact, nothing was recovered from possession of the

Considering the facts and circumstances of the case as well as period of detention of the petitioner in jail custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sohsarai P.S. Case No. 116 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate-III, Nalanda at Bihar Sharif.
