====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 29-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Bagaha (Patkhauli) P.S. Case No. 146/2018, instituted for the offences under Sections 457 and 380 of the Indian Penal Code.

It is alleged in the written report that on 06.04.2018 at 9.30 P.M. the petitioner came to the house of informant and asked whereabout of informant from his daughter. Thereafter petitioner also telephoned him. It is further alleged that on the next date when the informant reached his house, he found the lock of box was broken and Mangalsutra of his wife was missing. Learned counsel for the petitioner has submitted that

Patna High Court Cr.Misc. No.64651 of 2018 (2) dt.29-10-2018 2/2 there is no recovery of any incriminating article from possession of this petitioner. He has been made accused in this case merely on suspicion. He is in custody since 04.07.2018. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bagaha, West Champaran in connection with Bagaha (Patkhauli) P.S. Case No. 146/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
