The petitioner, who is in custody since 06.02.2020 and claims to be a person of clean antecedent, seeks bail in connection with Special Case No. 1218 of 2020, arising out of Maner P.S. Case No. 61 of 2020 dated 05.02.2020 instituted for the offence under Section 30(a)/37(c) of Bihar Excise Amendment Act, 2018.

From the prosecution report, it appears that from a kiosk, 50 litres of Mahua liquor was recovered. Other accused person viz. Sujit Kumar was also found drunk.

It has been submitted by the petitioner that the

Patna High Court CR. MISC. No.19245 of 2020(2) dt.08-06-2020 2/2 kiosk does not belong to the petitioner and he has been arrested on mistaken identity.

Considering the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Special Case No. 1218 of 2020, arising out of Maner P.S. Case No. 61 of 2020.
