Heard Mr. Ravi Shankar Sahay, learned Advocate for the petitioners and Mr. Praveen Kumar for the informant. The State is represented by the learned APP.

The petitioners seek bail in anticipation of their arrest in connection with Nathnagar (Madhusudanpur) P.S. Case No. 455 of 2019 dated 11.09.2019 instituted for the offences under Sections 341, 323, 506, 504, 498A and 34 of the Indian Penal Code.

The petitioners have been made accused in this case because of their being related to the husband of the informant. The

Patna High Court CR. MISC. No.29874 of 2021(2) dt.16-05-2022 2/2 petitioner no. 1 is the sister-in-law whereas the petitioner no. 2 is the brother-in-law of the informant. Apart from the general and omnibus allegation against the petitioners, it has also been charged that petitioner no. 2 kept an evil eye on her. The husband of the informant has already been released on bail.

Considering the nature of accusation against the petitioners and taking into account that such prosecution was initiated when the informant could not live happily with her husband and, therefore, the possibility of false implication of other members of the family of the husband, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bhagalpur in connection with Nathnagar (Madhusudanpur) P.S. Case No. 455 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
