Learned counsel for the petitioner has submitted that the matter has been settled between the parties as they are brothers and no useful purpose will be served by issuing notice to the Opposite Party No. 02 and keeping the matter pending in this Court.

Considering the same, this application is disposed of with liberty to the petitioner to move to the Court below and pray for dropping of the proceeding in view of the compromise. If the opposite party No. 02 supports the factum of settlement then the Court below will drop the criminal prosecution of the petitioner.
