Some stolen silver articles are said to have been recovered from the house of the petitioner and accordingly, he was remanded in the present case. Petitioner was put on test identification parade but he was not identified by the witnesses.

It is admitted case of the prosecution that recovery was made from the possession of other accused persons also and all the recovered articles were put on test identification parade which were identified by the witnesses. Therefore, it is obvious from the aforesaid fact that specific identification in respect of recovered material from the petitioner has not been done. Moreover, petitioner is in jail custody since 15.1.2016 and up till now, his trial could not be concluded.

Accordingly, petitioner is directed to be released on bail on

Patna High Court Cr.Misc. No.1684 of 2017 (3) dt.29-03-2017 furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge VI, Nalanda at Biharsharif in Sessions trial no. 296/2016 arising out of Rajgir P.S. Case no. 248/2015.
