The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner along with others stabbed the brother of informant.

It is submitted that allegation is general and omnibus. Injury report does not support the prosecution case. The doctor has found 04 injuries caused by hard and blunt substance. Petitioner claims clean antecedents.

Counsel for informant vehemently opposed the prayer for bail and submitted that there is allegation that this petitioner along with other stabbed the brother of informant causing

Patna High Court CR. MISC. No.21321 of 2023(2) dt.04-07-2023 2/2 grievous injury.

Considering the facts aforesaid and nature of injury, I am not inclined to enlarge the petitioner above-named on anticipatory bail in connection with Town P.S. Case No. 700 of 2022. Accordingly, the same is rejected.
