Let the defect(s), if any, be removed within a period of four weeks.
The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 354, 307, 379 and 504/34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent. The informant alleges that petitioner assaulted her causing injury on the head.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. It is further submitted that even presuming what has been alleged is true without admitting the same for the purpose of anticipatory
Patna High Court CR. MISC. No.20971 of 2022(2) dt.02-11-2022 2/2 bail then the blow was not repeated and from perusal of the order impugned, it would manifest that the injury is simple in nature.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Musrigharari P.S. Case No. 123 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
