JUSTICE BIRENDRA KUMAR ORAL ORDER 20-04-2017 The petitioner had earlier moved this Court for anticipatory bail in Cr.Misc.No.32156 of 2013. The said application was disposed of on 03.02.2014 with following order:- "After some arguments, learned counsel for the petitioner seeks permission to withdraw this case.
Permission is accorded.
Accordingly, this case is dismissed as withdrawn."
The petitioner neither challenged the aforesaid order nor complied the same rather again prayer has been renewed after more than three years. The Court was inclined to award heavy cost against the petitioner for misusing the process of law. However, learned counsel for the petitioner again prays for withdrawal of this application to surrender before the
Patna High Court Cr.Misc. No.8631 of 2017 (3) dt.20-04-2017 court below within ten days from today.
Hence, this application is dismissed as withdrawn in connection with Baruraj P.S. Case No.73 of 2011 pending in the court of learned Sub-Divisional Judicial Magistrate, West, Muzaffarpur with a direction to the petitioner to surrender within ten days from today and pray for regular bail.
