2. The petitioner seeks bail in connection with Amnaur P.S. Case No. 207 of 2023 instituted for the offences punishable under Sections 302/34 of the Indian Penal Code.
3. The allegation against the petitioner along with others is of brutally assaulted the informant and his family members due to which they sustained injury. It is further alleged that due to assault the father-in-law of the informant succumbed to injury.
4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. He submitted that there is general and omnibus allegation against the petitioner rather the specific allegation against co-accused
Patna High Court CR. MISC. No.26155 of 2024(2) dt.08-04-2024 2/2 Sandhya Devi, who assaulted the father-in-law of the informant due to which he died. Charge-sheet has been submitted in this case. The petitioner is in custody since 09.02.2023 and has no criminal antecedent.
5. Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case, there is no specific overt act against the petitioner as well as the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Amnour P.S. Case No. 207 of 2023.
