The petitioner apprehends his arrest in connection with Barauni (Rifinery) P.S. Case No.458 of 2016, registered for the offences punishable under Sections 25(1-b)A, 26, 35 of the Arms Act.
Allegedly, from the house of the petitioner one musket was recovered and the petitioner and his father succeeded in fleeing away. The mother present in the house disclosed that the musket was kept by her husband Bablu Poddar.
Submission is of false implication and that the petitioner is the son of Bablu Poddar, resulting, he has been implicated in this case, he has got no concern with the said
Patna High Court Cr.Misc. No.11427 of 2017 (2) dt.22-03-2017 2/2 musket. From F.I.R. itself it reveals that the said musket was kept by Bablu Poddar, the father of the petitioner in the house and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. fairly submits that the mother of the petitioner has disclosed that the said musket was kept by Bablu Poddar and not by the petitioner.
In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Barauni (Refinery) P.S. Case No. 458 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
