Petitioners are the mother, sister of accused No. 1 Tuntun Yadav whose wife Rima Devi is the victim. Present case has been registered for the offence under Section 302/34 of the Penal Code alleging murder of Rima Devi by Tuntun Yadav, these petitioners and others.
It is submitted on behalf of the petitioners that Rima Devi committed suicide as earlier she has disappeared from the house, later her dead body was recovered and then cremated whereafter the present case was lodged.
Petitioner No.1 being the mother-in-law of the
Patna High Court Cr.Misc. No.40244 of 2015 (2) dt.07-10-2015 2/2 deceased Rima Devi she is directed to surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order in the court below and apply for regular bail, which should be considered in accordance with law. So far petitioner no. 2 is concerned, she being the married sister of Tuntun Yadav, she should also surrender in the court below within the same time and thereafter be released on bail on furnishing bail bond of Rs. 5,000/-(Five Thousand) with two sureties of the like amount each to the satisfaction of Sri Lalan Kumar, Judicial Magistrate, Ist Class, Jamui in connection with Chakai P.S. Case No. 61/14, subject to the condition as laid down under Section 438(2) Cr.P.C.
