The petitioners seek bail in anticipation of their arrest in connection with Sonbarasa P. S. Case No. 119 of 2018 dated 25.06.2018 instituted for the offence under Sections 379 of the Indian Penal Code.

Eight solar plates, which were installed under a government scheme, were found to be missing. The prosecution of the petitioner in the present case is on the basis of recovery of two of such solar plates from their roof tops.

No.66604 of 2018(2) dt.17-12-2018 2/2 submitted that the aforesaid solar plates, which are said to have been recovered from their roof tops, are the ones which they have purchased. In support of this contention, learned counsel for the petitioners has drawn the attention of this Court to the sale-letters of the aforesaid solar plates. Taking this fact into account as also that the petitioners are not named in the F.I.R. and they have clean antecedents, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Sonbarasa P. S. Case No. 119 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C. (Ashutosh Kumar, J) skm/- U
