ANJANA PRAKASH ORAL JUDGMENT Date: 09-02-2016 The petitioners seek quashing of the order of cognizance dated 11.05.2009 passed in Complaint Case No. 571 of 2002. The case of the complainant is that the Petitioner no. 2 and his associates had attempted to control over Nawada Zila Prathmik Shikshak Sangh by declaring themselves as Office Bearers even though there was no justification for them to do so. It has been submitted on behalf of the petitioners that even conceding the allegations, no offence is made out. Having gone through the facts of case, I would be inclined to agree with such submission. Hence the application is allowed without prejudice to rights of the parties and the proceedings including the order dated 11.05.2009 passed in Complaint Case No. 571 of 2002 is hereby quashed.
