The petitioners apprehend their arrest in Mehsi P.S. Case no. 100/13, registered for the offences punishable under Sections 302 and other Sections of the Indian Penal Code.

Patna High Court Cr.Misc. No.45859 of 2014 (5) dt.22-06-2015 2/2 The petitioners are not named in the FIR. During the course of investigation the witnesses have stated that the petitioners were seen with Rajesh Yadav. One Kailash Kumar was apprehended and he confessed his guilt disclosing the name of the petitioners along with others. Other accused persons namely, Deepak Kumar and Umesh Rai have been granted regular bail. Considering the facts aforesaid, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.

However, the petitioners, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered and disposed of taking into consideration that similarly situated co-accused have been granted bail.
