JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-10-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 341, 307, 504 of the Indian Penal Code. The prosecution case is that the accused persons assaulted the wife and daughter-in-law of the informant with lathi when the informant and his son went to rescue then they were also assaulted.
It is submitted by learned counsel for the petitioners that only informant and informant's daughter-inlaw received injuries. There is counter version of the occurrence and from the petitioners' side two persons also received injuries. Moreover the accusation has been levelled in the background of serious land dispute.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

No.41158 of 2015 (2) dt.07-10-2015 2/2 Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Madhubani in connection with Rahika P.S. Case No. 15 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
