Petitioner seeks regular bail in connection with Chabilapur P.S. Case No. 11 of 2020 registered for the offence under Section 302, 120B, 34 of the I.P.C.

The allegation as per the First Information Report is that the petitioner along with other accused persons caught hold the deceased and the co-accused / Sajan Rajbanshi assaulted him with the help of bricks due to which he died. Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged

Patna High Court CR. MISC. No.30477 of 2021(2) dt.08-12-2021 2/3 and he has falsely been implicated in this case due to village rivalry. He next submits that doctor has found abrasion on the chest only of the person of the deceased which is attributed against Sajan Rajbanshi. He further submits that similarly situated co-accused persons - Krishna Rajbanshi, Manoj Rajbanshi & Dharmendra Rajbanshi (in Cr. Misc. No. 24964 of 2020) and Akis Kumar (in Cr. Misc. No. 38417 of 2020) have been granted bail by different Co-ordinate Benches of this court.

Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that similarly situated accused persons have been granted bail by different Co-ordinate Benches of this Court and allegation against the petitioner is general and omnibus in nature, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- V, Nalanda at Biharsharif in connection with Chabilapur P.S. Case No.

Patna High Court CR. MISC. No.30477 of 2021(2) dt.08-12-2021 3/3 in case of default on two consecutive dates on the part of the petitioner, his bail bond shall liable to be cancelled.
