JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2018 The petitioner seeks regular bail in connection with Kangali P.S. Case No. 17 of 2018, registered for offences punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

Allegation against the petitioner is of selling the land, which belonged to the petitioner.

It has been submitted on behalf of the petitioner that the complainant and petitioner are the agnates and earlier a proceeding under Section 144 Cr.P.C. was also initiated on the land in question and further a title suit is also pending between the parties. Further submission is that the dispute between the parties is purely civil in nature and for that petitioner has been in judicial custody since 14.07.2018.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Kangali P.S. Case No. 17 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
