The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

2268 liters of illicit foreign liquor has been recovered from from Hayva vehicle, of which, this petitioner is driver. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner, being driver, was simply following the instruction of owner and he was not aware about the nature of consignment, which was being transported in the vehicle.

However, learned A.P.P. for the State vehemently

Patna High Court CR. MISC. No.21052 of 2022(2) dt.29-07-2022 2/2 opposed the prayer for anticipatory bail and submitted that petitioner is driver of the vehicle, from which, huge quantity of liquor has been recovered.

Considering the aforesaid facts and circumstances., the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay/- U T
