The petitioner apprehends his arrest in Giriyak (Katrisarai) P.S. Case No. 363 of 2016 instituted for the offence under Sections 467, 468, 471, 420, 120(B) of the Indian Penal Code, Section 66 of the I.T. Act, 2008, Sections 18(A), 18(B), 18(C), 27(C), 28(A), 27 (B) Ii, 33 EEE (B), 33(1) of Drugs & Cosmetic Act, 1940 and Sections 3, 4, 5, 7, 9(A) of Magic Remedies Act, 1954. The First Information Report has been lodged on the basis of self statement of the informant alleging therein that business of illegal medicine and cheating has been done under the scheme of Chehra Pahchano Inam Pao. It is further alleged that

No.4439 of 2017 (2) dt.14-02-2017 2/2 thirteen persons were apprehended and on their statement, the house of this petitioner was also searched and two stamps of Baidya Nand Kishore Prasad and another articles as mentioned in seizure list, were recovered from possession of this petitioner. It has further been submitted that petitioner is "Baidya" for which a certificate has been enclosed with the bail petition, as Annexure-2. In the circumstances, prayer of the petitioner for anticipatory bail is allowed.

In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Giriyak (Katrisarai) P.S. Case No. 363 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Bihar Sharif, subject to the conditions as laid down under Section 438(2) Cr.P.C.
