Petitioner is in custody since 18.01.2020 and seeks bail in connection with Bakhtiyarpur P. S. Case No.455 of 2019 registered for the offences punishable under Sections 379, 504, 506, 34 of the I.P.C.
Petitioner is not named in the first information report, but it appears from perusal of impugned order that in course of investigation, petitioner was arrested on suspicion and made his confessional statement leading to recovery of stolen generator from the house of co-accused Mahendra Paswan. Patna High Court CR. MISC. No.20566 of 2020(2) dt.01-09-2020 2/2 accused Mahendra Paswan has already been granted privilege of bail and, moreover, petitioner has not been put on T. I. Parade. Petitioner does have criminal antecedent of one case, but that case was not registered for the offence of theft. Considering the aforesaid facts and circumstances of the case as well as submissions of the parties and also taking note of the period of detention of petitioner in custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Bhakhtiyarpur P. S. Case No.455 of 2019.
