JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2018 The petitioner seeks regular bail in connection with Dehri (Town) P.S. Case No. 33/2018 (P.O.C.S.O. Case No. 04/2018), registered for offences punishable under Sections 342, 354(A)(D)(2), 509, 506 and 34 of the Indian Penal Code and section 8/12 of the P.O.C.S.O. Act.

Allegation against the petitioner is of misbehaving with the informant who is minor, taking obscene photographs and also threatening her and her family members after death of her father. He tried to lift her by the motorcycle. Submission of learned counsel for the petitioner is that no case under Section 8/12 of P.O.C.S.O. Act is made out as the informant is major and is college going girl. The instant case has been lodged at the instance of officer-in-charge, as mother

Patna High Court Cr.Misc. No.65365 of 2018(2) dt.20-11-2018 2/2 of the petitioner has lodged complaint case against officer-incharge. Further submission is that petitioner is in custody for more than three months.

Learned A.P.P. opposed the prayer for bail.

Having heard both sides, considering the facts and circumstances of the case, let the petitioner above-named, be released on bail on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-Icum-Special Court P.O.C.S.O. Act, Rohtas in connection with Dehri (Town) P.S. Case No. 33/2018 (P.O.C.S.O. Case No. 04/2018), subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
