The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 34 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, on hearing hulla that one Mantu Paswan sustained gunshot injury, it is stated by the informant that his sons were at the door of his house. At this time Shiv Shankar Sah, Akhilesh Sah and others reached there armed and resorted to firing as a result of which the informant's son Chandan Yadav sustained gunshot injury in chest and stomach.

It is submitted by learned counsel for the petitioner that the the petitioner is not named in the FIR. His name

Patna High Court CR. MISC. No.29621 of 2021(4) dt.08-02-2022 2/2 transpired in course of investigation only on the basis of suspicion. The allegations are general and omnibus in nature. Co-accused Sunil Paswan has been enlarged on bail vide order dated 27.3.2019 passed in Cr. Misc. No. 17552 of 2019. The petitioner is in custody since 25.10.2020 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the material that has transpired in course of investigation and grant of bail to the co-accused, the petitioner is directed to be enlarged on bail in connection with Charpokhari P.S. Case no. 83 of 2015 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Bhojpur at Ara.
