This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Sultanganj PS Case No. 254 of 2018 for the alleged offence punishable under Sections 401, 379, 411 and 414 of the Indian Penal Code, Section 25(1-b)a, 26 and 35 of the Arms Act and Section 30(a)/38 of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner in the instant case is that one mobile phone was recovered from the possession of the petitioner. Learned counsel representing the petitioner submits that except one mobile phone nothing incriminating article was

He further submits that petitioner has no criminal antecedent and he is in custody since 08.09.2018 Considering the fact that petitioner has no criminal antecedent and he has remained in custody for six months, this application is allowed.

Accordingly, let the petitioner above-named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna in connection with Sultanganj PS Case No. 254 of 2018.
