JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 03-06-2020 Heard the parties through the virtual court proceeding. The petitioner seeks bail in connection with Chandan P.S. Case No. 196 of 2018 registered for the offences punishable under Sections 25(1-b)a/35 of the Arms Act.

The case of the prosecution in short is that the informant on 29.12.2018 along with other police officials was on routine patrol and at about 08:10 pm the informant saw a car coming from Deoghr sid and when the said car was stopped by the gesture of light but instead of stop the driver of the car tried to escape but the aforesaid car was chased by the police and after a distance four persons got out of the car and they managed to escape after taking the advantage of darkness. When the car was searched by the police then the registration number of the case is JH10AA 7911 and one country made pistol along with

Patna High Court CR. MISC. No.18445 of 2020(2) dt.03-06-2020 2/2 two cartridges was recovered from the rear seat of the car. The police also found one mobile phone of Samsung company on the dashboard of the car.

Learned counsel for the petitioner submits that the petitioner is innocent and is falsely implicated in this case. He further submits that in the supervision, the Dy.S.P. found that the owner, driver and two other person in the car were falsely implicated. Learned counsel for the petitioner further submits that nothing incriminating was recovered from possession of this petitioner. Petitioner is in jail custody since 31.12.2019. Learned A.P.P. for the State has opposed the prayer. In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of C.J.M., Banka in connection with Chandan P.S.
