Mr.Md. Fahimuddin,APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 16-06-2020 This application has stood dismissed for noncompliance of the peremptory order by which the petitioner was directed to remove the defects.
It is the contention of the petitioner in the restoration application that he had filed inspection slips and removed the defects also within time but the defects were not properly removed to the satisfaction of the concerned stamp reporter, therefore the application has been dismissed in default. It appears from the stamp reporter's note dated 05.03.2020 that according to him defect no. 6(3) is still stand as per computer report at Flag 'B'. Flag 'B' is a supplementary affidavit on behalf of the petitioner in which he has made
Patna High Court CR. MISC. No.19408 of 2020(2) dt.16-06-2020 2/2 statements in paragraph '5' to remove defect no. 1 to 6. On perusal of the same, it appears that in the affidavit substantial compliances have been made and this Court is satisfied that for the reasons stated in the stamp reporter's note this revision application need not be dismissed showing non-compliance. Thus, Criminal Revision 1435 of 2019 is restored to its original file.
The present application is allowed.
