2. The petitioner is in custody since 01.05.2016 in connection with Bidupur P.S. Case No. 113 of 2016 for the offences alleged under Section 47(a) of the Bihar Excise (Amendment) Act.
3. It is submitted that the petitioner has been falsely implicated and in fact he is a resident of village Terasiya and not village Mustafapur, the place from where 70 litres of country made liquor were recovered. It is submitted that co-accused Lal Babu Rai, the owner of the land, has been granted bail by the learned court below.
4. Having regard to the nature of accusations, gravity of offence alleged and considering that the wooden 'Gumti' from where 70 litres of country made liquor were recovered is said to be belonged to the petitioner, this Court is not inclined to grant bail to the petitioner.
